The Promoter

The promoter is: FANKS LTD with company number 16486448 and a registered office address of 20 Wenlock Road, London, England, N1 7GU (the Promoter).

1. The Prize draw

The title of the prize draw is ‘Win A Banksy’. The prize draw opens on 01/08/25 at 00:23 GMT (the Opening Date) and closes on 23/12/25 at 20:57 GMT (the Closing Date). The prize draw is to win an original Signed and numbered Banksy canvas, acquired directly from Santa’s Ghetto, London 2003 (the Prize). This canvas has never before been offered at auction. The canvas comes complete with a signed and dated Certificate of Authenticity (COA). The actual canvas? That secret stays under wraps until the drop. But if you’re sharp enough you will find the clues are in the content.

2.Entry requirements

The prize draw will be open for entries from the Opening Date through to and including the Closing Date, as specified on the Website. However, postal entries must be received at least seven calendar days before the Closing Date, as set out in point 3.2 below. These terms refer to the official start and end dates of the prize draw period. All times and dates referred to are the times and dates in London, England.

All prize draw entries must be received by the Promoter by no later than the specified time on the Closing Date. All prize draw entries received after the specified time on the Closing Date are automatically disqualified, and no refunds will be given.

There is no maximum number of entries to the prize draw.

By submitting a prize draw entry, you are entering into a contract with the Promoter and agreeing to be bound by these terms and conditions.

3. How to enter – paid entry and free postal entry routes

You must be over the age of 18 and be a resident of the United Kingdom to enter. Entries from individuals who do not meet these eligibility criteria will be disqualified.

3.1 Paid entry

To Enter the prize draw using a paid entry on our website:

        • Complete and submit the online entry form; then
        • Purchase the required number of entries; then
        • When you have purchased your entries, submit your entry to the Prize draw.

Please submit all entries in English. Unfortunately, entries in other languages cannot be accepted and will be disqualified without refund.

The Promoter will not accept responsibility for prize draw entries that are not successfully completed, are lost, or are delayed regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

3.2 No Purchase Necessary – Free Postal Entry

An alternative, no-purchase-required method of entry is available for the prize draw. To enter without making a purchase, you must follow the instructions outlined below:

To submit a free entry, you must:

Send your entry via first- or second-class post in a sealed envelope. Your entry must include a postcard including the following details. Be sure to write clearly - if we can’t read it, we can’t count it.

      • Your city and postcode
      • A valid contact telephone number and email address
      • If applicable, please also include your Instagram or TikTok handle so we may contact you via social media should you win.
      • The full title of the prize draw “Win A Banksy”
      • We invite you to craft your own postcard, featuring original artwork—painted, drawn, photographed, or collaged. Personal expression isn’t just welcomed—it’s the point.

Send your postcard in a sealed envelope to the Promoter at the following address: FANKS LTD, Department 126, 19 Lever Street, Manchester, M1 1AN, UK.

Prize draw entries cannot be returned.

Important Rules & Conditions for Free Postal Entry:

• • • • Each free entry must be submitted separately in its own envelope. Bulk entries in one envelope will not be accepted and will be counted as a single entry.
      • By entering, you confirm that you meet all eligibility requirements and accept these terms and conditions.
      • Postal entries will be treated equally to paid entries in the draw. However, they must be received at least seven calendar days before the Closing Date, which means that the latest a postal entry can be received by us to be counted is 16^th December 2025. Any entries received after this deadline will not be entered.
      • The Promoter will not acknowledge receipt of postal entries or confirm whether answers are correct.
      • Failure to comply with these conditions or the general terms and conditions will result in disqualification.

The Promoter may occasionally allow free entry to the Prize Draw to be made in-person at events or at other locations (Pop-Ups). Entries at Pop-Ups are limited to one per person and only for those who have paid to attend the event (where applicable). Further instructions on entry to the Prize Draw at Pop-Ups will be given in-person to those eligible attendees.

4. Choosing a Winner

The winner of the prize draw (Winner) will be drawn at random from all eligible entries received by the required deadline of: for paid entries, the Closing Date; or for free postal entries, 48 hours before the Closing Date. The draw will be conducted with integrity and transparency, supervised by an independent person on 23/12/25 at 21:00 ("Draw Date"). The Winner will be contacted via the details provided upon entry.

Once the Winner has been announced, they - along with close family or a chosen representative, will be invited to a private unveiling at a confidential venue (the Live Event). The guest list and location will remain undisclosed until shortly before the Live Event. Should the Winner be unable to attend, the Promoter reserves the right to proceed with the Live Event and the Winner may nominate a representative to attend and accept the prize on their behalf.

Ownership of the prize will remain with the Winner.

The Winner’s absence will not affect their entitlement to the prize. Additionally, the Promoter reserves the right to issue press releases, make public announcements, and create promotional materials relating to the prize draw and its outcome. The surname and county of the Winner may be published or made available to ensure transparency. However, if the Winner objects to this, they may inform the Promoter in writing. In such cases, the Promoter will respect the Winner’s wishes and withhold these details from public disclosure, unless required to share them with relevant legal or regulatory authorities.

5. Eligibility

The prize draw is open to all residents of the United Kingdom who are aged 18 years or over, with the exception of the following (Prohibited Persons):

• Employees of the Promoter;
• Employees of the Promoter’s agents or suppliers who are professionally connected with the prize draw or its administration;
• Immediate family members or members of the same household of any of the above. By entering the prize draw, you confirm that you meet the eligibility requirements and are legally entitled to claim any Prize you may win. The Promoter reserves the right to request proof of your eligibility at any stage. This may include, but is not limited to, a valid form of identification such as a passport, driving licence, or recent utility bill. Failure to provide satisfactory evidence within a reasonable timeframe may result in disqualification. The Promoter will not accept entries that are:
• Automatically generated by computer or other automated methods; or
• Incomplete, illegible, or corrupted.

The Promoter reserves the right to disqualify any entrant whose conduct is deemed to be in breach of these terms, or contrary to the spirit and integrity of the prize draw.

Entry Fee & Disqualification

Entry fees are non-refundable under any circumstances, including (but not limited to) the following:

• If you discover after entry that you do not meet the eligibility criteria;
• If, due to unforeseen and unavoidable circumstances, including a change in applicable law, eligibility criteria change after your entry and you no longer qualify;
• If you are disqualified from the prize draw for any reason, including failure to comply with these terms.

6. The Prize

The Prize is non-negotiable, non-transferable, and subject to availability. No cash alternative will be offered unless circumstances beyond the Promoter’s control make it unavoidable, in which case a cash equivalent may be substituted at the Promoter’s discretion, subject to reasonable deductions for advertising, administrative, or operational costs directly related to the prize draw. Any such deductions will be clearly communicated.

The Promoter reserves the right to substitute the Prize with another of equal or greater value if necessary due to unforeseen circumstances. Any changes will be announced on the Website and/or official social media channels as soon as reasonably possible.

The Promoter is committed to awarding the advertised prize to the selected winner.

Furthermore, the Promoter may modify, suspend, or terminate the prize draw if its fair and proper conduct is compromised due to fraud, technical issues, or other circumstances beyond the Promoter’s reasonable control.

The Promoter shall not be liable for any delay or failure to fulfil its obligations due to circumstances outside its control, including but not limited to natural disasters, war, civil unrest, epidemics, or government action.

7. Winners

The decision of the Promoter is final and no correspondence or discussion will be entered into. The Winner's full name will be announced at the Live Event. If you wish for your name to be censored during the Live Event please contact crew@sayfanks.com with reasonable time left before the prize draw takes place.

The Promoter will contact the winner personally as soon as practicable after the Draw Date, using the email address provided with the prize draw entry. If the winner cannot be contacted or is not available, or has not claimed the Prize within 21 days of the Draw Date, the Promoter reserves the right to offer the Prize to the next eligible Entrant selected from the entries that were received before the Closing Date.

The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation, the Promoter will publish the surname and county of the Winner on the Website.

If you object to any or all of your surname and county being published or made available, please contact the Promoter at crew@sayfanks.com prior to the Closing Date. In such circumstances, the Promoter must still provide the information to the Advertising Standards Authority on request.

8. Claiming the Prize

The Prize must be claimed personally by the Winner or by a third party authorised in writing by the Winner. If someone other than the Winner is collecting the Prize, they must provide valid identification and proof of authorisation. Details of how the Prize will be delivered or made available for collection will be made clear and published on the Website.

If your personal details, including contact information, change at any time, you should notify the Promoter as soon as reasonably possible. Notifications should be sent to the Promoter via email to crew@sayfanks.com. Notifications must include details of the prize draw you have entered, your old details, and your new details. If your details

change within 10 days of the Closing Date, the Promoter will use your old details if it needs to try to contact you.

The Promoter does not accept any responsibility and is not liable to pay any compensation if you are unable to or do not take up the prize.

9. Limitation of Liability

Insofar as is permitted by law, the Promoter, its agents, or distributors will not in any circumstances be responsible or liable to compensate the Winner or accept any liability for any loss, damage, personal injury, or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter, its agents, or distributors or that of their employees. Your statutory rights are not affected.

10. Refunds

Any entry fees are non-refundable under any circumstances. By entering, you acknowledge and accept that entry fees will not be refunded for any other reason, including but not limited to participant withdrawal, disqualification, or dissatisfaction. Unauthorised chargebacks or payment disputes may result in disqualification and forfeiture of all entries and prizes.

11. Data Protection and Publicity

By entering the prize draw, you agree that any personal information provided by you with the prize draw entry may be held and used only by the Promoter or its agents and suppliers.

If you are the Winner of the prize draw, you agree that the Promoter may use your name, and county of residence to announce the winner of this prize draw. You further agree to participate in any reasonable publicity required by the Promoter. With your consent the Promoter may use your image as part of the publicity to be agreed with you, you may choose not to have your image used for promotional purposes. You are entitled to request further details about how your personal information is being used.

If you do not wish to participate in any publicity, you must notify the Promoter prior to the Closing Date. This will not affect your chances of winning the Prize. If you do not agree to participate in any publicity about the prize draw, we may still provide your details to the Advertising Standards Authority. This is a legal requirement that we must comply with to prove that the prize draw has been properly administered and the Prize awarded.

If you are the Winner of the prize draw, you may be required to provide further personal information and proof of your identity in order to confirm your eligibility to claim the Prize and transfer ownership of the Prize to you. This is part of the condition of the prize draw.

If you are the Winner and you choose not to accept the Prize the Promoter reserves the right to offer the Prize to the next eligible Entrant selected from the entries that were received before the Closing Date.

Please note that under data protection laws, you are entitled to request that the Promoter does not contact you and removes your details from its database. If you make such a request you will be withdrawing from the prize draw as it will not be possible to contact you in the event that you are the Winner. You will not be entitled to any refund of any entry fee if you withdraw from the prize draw.

If you do not wish for any of your personal details to be used by the Promoter for promotional purposes, please email the Promoter at crew@sayfanks.com prior to the Closing Date.

11.1 Postcard Submission and Rights

By sending us your original postcard, you agree to transfer ownership of the physical postcard and assign to us all rights, title, and interest in the artwork, including copyright. This allows us to use, reproduce, display, publish, distribute, and sell the postcard or derivative works—such as prints, merchandise, or artworks based on the design—for promotional, archival, exhibition, commercial, or other purposes, in any media now known or developed in the future, without any obligation to pay royalties or fees.

12. General

If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the prize draw and any future prize draws.

The Promoter reserves the right to hold void, suspend, cancel, or amend the prize draw where it becomes necessary to do so.

These terms and conditions are governed by English law. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts in the United Kingdom.
